Melbourne Brick pavers online terms and conditions

This agreement is a contract between you and Melbourne Brick Co P/L (ABN 25 006 995 491) (Melbourne Brick Online), Level 1, 25 Playne St, Frankston VIC 3199.

Please read these terms and conditions carefully before placing your order with Melbourne Brick Online. By completing and submitting your order form online and using the Melbourne Brick Online service, you acknowledge that you have read and agree with the terms and conditions outlined below and our standard terms and conditions of sale. Melbourne Brick Online reserves the right at all times to make changes to the Melbourne Brick Online terms and conditions at its sole discretion without prior notice.

1. Definitions

Agreement means an agreement between you and Melbourne Brick Online to supply Goods.

Shipping Address means the address to which the Goods are to be delivered as stated on the Order.

Receipt Order Number Total means the fee payable to Melbourne Brick Online in respect of shipping of the Goods as advised by Melbourne Brick Online from time to time.

Goods means the goods described in an Order

Order means an order by you to purchase Goods from Melbourne Brick Online.

Personal Information includes, but not limited to, your name, Shipping Address and payment details.

2. Order

1. You warrant that all information and data provided by you in the Order is true and correct. You must promptly inform Melbourne Brick Online if there is a change to this information or data.
2. Orders are deemed to be received by Melbourne Brick Online at the time of successful transmission of the order and confirmation received to you.

3. Price of Goods and Payment

1. All Goods are quoted in Australian dollars and include GST. Prices shown include shipping but not installation.
2. Melbourne Brick Online reserves the right to change or alter prices of Goods without notice. The price payable by you shall be the price applicable on the date the Goods are confirmed as ordered and payment in full is made.
3. You must pay for the Goods at the time you place your Order. Orders cannot be paid for at the time of shipping.
4. Orders may be paid for by Visa, Mastercard, Amex or EFT to our nominated bank account.
5. Melbourne Brick Online will issue a Tax Invoice, setting out the total amount including GST payable. If the rate of GST is varied from 10%, the consideration for any shipping under this Agreement will be varied to reflect the change of rate. Any terms used in this clause which are defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth) and related Acts as amended from time to time (GST Act) are taken to have the meaning as defined in the GST Act.

4. Shipping

1. The Goods ordered will be delivered to the Shipping Address nominated by you in the Order.
2. Shipping of Goods is limited to the area as defined by us as metropolitan Melbourne. Areas outside of this and within Victoria will incur additional shipping charges as notified by us to you once order is sent and prior to payment and acceptance of order by you.
3. A Melbourne Brick representative will contact you within 24 hours of receiving your Order to arrange a date for shipping within 72 hours of cleared payment in full (Shipping Date). The Shipping Address may be amended not less than 24 hours prior to the scheduled Shipping Date.
4. You must allow up to 72 hours within metropolitan Melbourne for shipping of your order (we will quote shipping time to other locations), depending on availability and location of shipping address.
5. Melbourne Brick Online will use reasonable endeavours to deliver the Goods on the Shipping Date. However, Melbourne Brick Online will not accept responsibility for late shipping or loss or damage suffered as a result of a delay in shipping or any out of stock item.
6. A person must be at the Shipping Address to accept the Goods on shipping. Anyone at the Shipping Address who receives the Goods shall be presumed by Melbourne Brick Online to be authorised to receive the Goods on your behalf. If there is no one at the Shipping Address we will leave the goods as close to the agreed point when we confirm order with you or on the nature strip if no one is home to receive goods or no or limited access and the goods will be accepted as delivered. If the Goods need to be returned due to no unloading points available or anyone to accepts goods you will need to contact Melbourne Brick to arrange re-shipping. Additional Shipping Fees will apply to redeliver the Goods.
7. Melbourne Brick Online will not accept responsibility for late shipping or non-shipping due to incomplete or incorrect details provided.

5. Cancellation

1. Orders may be cancelled prior to shipping by contacting Melbourne Brick Online on 1300 722 102 24 hours prior to shipping.
2. Melbourne Brick Online reserves the right to charge you a cancellation fee of 10% of the value of the Goods ordered once your Order is processed to cover administrative costs.
3. Refunds for cancellations will be made to your nominated credit card.

6. Products

Manufacturers Recommendations: COLOUR – Because of the variation in colour which is usually found in fired clay and masonry products, the manufacturer recommends that purchasers take delivery of all goods proposed to be purchased from the Vendor for incorporation in construction, at the same time and blend them to avoid obvious colour contrasts.

7. Risk and Title

Risk and title in the Goods passes upon shipping of the Goods to the Shipping Address.

8. Liability

1. Melbourne Brick Online will use reasonable care and skill in providing the Melbourne Brick Online website for you.
2. To the greatest extent permitted by law, you release and discharge Melbourne Brick Online and its related bodies corporate from all forms of loss or damage (including but not limited to loss of profit, loss of data, third party claims, liquidated damages) arising out of or in connection with Melbourne Brick Online or this Agreement.
3. If the Trade Practices Act 1974 or any other legislation implies a condition or warranty into this Agreement in respect of goods or services supplied, and Melbourne Brick Online’s liability for breach of that condition or warranty may not be excluded but may be limited, Melbourne Brick Online’s liability for any breach of that condition or warranty is limited to:

9. Privacy

1. Personal Information collected will be used solely for the purpose of processing and delivering the Order. Personal Information may be shared with a third party shipping agent for the purposes of delivering your Order. For details on Melbourne Brick Privacy Policy terms click here.
2. Melbourne Brick Online will confirm payment options over the phone when confirming order. If payment is made by credit card your financial and credit card details are not stored for future use or shared with Melbourne Brick Online.
